The cases cited are not the last point on this issue. Guaranteed. At some point someone will invest the time and money into attacking this case, and other cases like it. Internet and copyright law are always up for interpretation, especially as the information age really does move into a real "information" age.
David - be careful of citing NOLO press. NOLO is a do-it-yourself-law outfit in California that publishes books on many legal topics. They have been sued for the unauthorized practice of law in Texas and I believe in a few other states as well. The cases they hand out are usually cases that subscribe to their point of view.
As a lawyer (although not a copyright lawyer), I love a good legal discussion as much as anyone else in my profession, but this is getting off topic of Mid/Renn MA. Further posts should be on the e-list.
